Release

I, as a participant in the sporting event known as Quito Trail by UTMB® (hereinafter, “the race”), organized by PA S.A.S., declare that I have read, understood, and voluntarily signed this waiver, and that I accept all risks related to my participation.

1. Assumption of Risk I take full responsibility for any material loss or damage, illness, physical injury, or death that I may suffer as a direct or indirect result of participating in the race. I solemnly declare that I do not suffer from any acquired or congenital physical conditions or injuries that could compromise my health or quality of life during the event. I confirm that I have undergone a prior medical check-up and that I am in optimal physical condition to participate. I acknowledge and accept the inherent risks of the race, including but not limited to: falls, contact with other participants, adverse weather conditions, vehicular traffic, terrain conditions, and any other risks that may arise.

2. Waiver of Liability I accept that neither PA S.A.S., nor the sponsoring brands, nor the owners of the venues through which the race passes, nor their affiliated, parent, or subsidiary companies shall be held liable for any compensation, claim, cost, damage, or harm, including but not limited to: accidents, physical, psychological, or moral damages, loss of income, or any impact to myself or my beneficiaries resulting from my participation.

3. Legal Jurisdiction This declaration is governed by the laws of the Republic of Ecuador, to whose jurisdiction I voluntarily submit.

4. Medical Attention and Evacuation I authorize the race’s medical teams to administer any treatment deemed necessary during the event. I give my informed consent to be evacuated in case of an accident and agree to cover the full cost of such evacuation, regardless of the means used. I also authorize the request for evacuation if I am unable to do so myself.

5. Image Use I authorize the organizers and sponsors of the race to use, reproduce, distribute, and publish photographs, videos, recordings, or other media of my participation, without any financial compensation.

6. Personal Data Protection and Commercial Authorization I authorize all personal data collected by PA S.A.S., its associated, affiliated, and related companies—including those offering financial services and payment facilities for race registrations—to be processed in accordance with the laws of the Republic of Ecuador, particularly the Organic Law on Personal Data Protection. Such data may be used for marketing activities, commercial communication, promotional information, statistics, market research, invitations to events organized or sponsored by PA S.A.S. and its commercial partners, as well as for the management of financing processes and financial services related to the race. I also authorize the transfer of this data to third parties, including affiliated, parent, or subsidiary companies of PA S.A.S., for legitimate commercial purposes compatible with the objectives described herein. I declare that I have been informed of my rights as the data subject, including access, rectification, cancellation, opposition, and portability, and that I may exercise these rights through the mechanisms established by Ecuadorian law.

Final Acceptance I certify that I have read and understood this waiver, that I accept all terms and conditions set forth herein and in the race regulations, and that I submit to the authority of the Race Committee, which may enforce the rules in all matters related to the event.
